Terms and Conditions (Giveaway 2025)

The NYK USA Giveaway 2024 (the “Giveaway”) is organized by NYKUSA (“Company,” “we,” “us,” or “our”). By participating in this Giveaway, you agree to comply with these Terms & Conditions. If you do not agree, please do not participate.

1. Eligibility

• This Giveaway is open only to legal residents of the United States, aged 18 years or older at the time of entry.

• Employees of NYKUSA, affiliates, partners, and their immediate family members are not eligible to participate.

• The Giveaway is void where prohibited by law.
  
  
  

2. How to Enter

To enter the Giveaway, participants must:

1. Follow NYK USA Instagram page.

2. Like the Giveaway post.

3. Like and Share the Giveaway post on Instagram Stories, tagging @NYKUSA.

1. Each new share counts as a separate entry for the free t-shirts.

3. Prizes

The Giveaway includes:

• 20% Promo Code – Given to all participants who complete the required steps.

• 10 Free T-Shirts – Awarded to 10 randomly selected participants.

• 3 Premium Custom T-Shirts – Awarded to 3 hand-picked participants based on engagement, creativity, and participation.

• Winners may submit a custom design, concept, or image, and NYKUSA will create the t-shirt.

All prizes are non-transferable, non-refundable, and cannot be exchanged for cash.

4. Winner Selection & Notification

• Winners will be selected as follows:

• 10 Free T-Shirt Winners – Randomly chosen from eligible entries.

• 3 Premium Custom T-Shirt Winners – Selected based on engagement, creativity, and participation.

• Winners will be announced on our Instagram page and notified via Instagram Direct Message (DM).

• If a winner fails to respond within 48 hours, a new winner will be selected.
  
  
  

5. Publicity & Rights

By participating, winners grant NYKUSA permission to use their name, Instagram handle, and submitted design (for custom t-shirts) for promotional purposes, without additional compensation, except where prohibited by law.

6. Custom Design Restrictions

For winners of the premium custom t-shirts, submitted designs must:

• Be original or legally owned by the participant.

• Not include offensive, obscene, trademarked, or copyrighted content unless permission is granted.

• Be subject to approval by NYKUSA.

We reserve the right to reject any design that violates these rules.

7. Disqualification

NYKUSA reserves the right to disqualify participants who:

• Use fake accounts, bots, or automation to enter.

• Submit inappropriate content or violate Instagram’s guidelines.

• Engage in any fraudulent activity to manipulate results.
  
  
  

8. Liability & Indemnification

By participating, you agree that NYKUSA, its affiliates, and employees are not responsible for:

• Technical failures affecting participation (e.g., Instagram downtime, internet issues).

• Lost, delayed, or misdirected entries.

• Any damages, injuries, or losses arising from participation or prize acceptance.

Participants agree to release and hold harmless NYKUSA from any claims related to the Giveaway.

9. Privacy Policy

By entering, participants consent to NYKUSA collecting and using personal information only for the purposes of this Giveaway. We do not sell or share personal data with third parties, except as needed to fulfill prizes. See our Privacy Policy for details.

10. Governing Law

This Giveaway is governed by the laws of the United States, without regard to conflict of law principles.

11. Changes & Termination

NYKUSA reserves the right to modify, suspend, or cancel the Giveaway at any time if necessary, due to fraud, technical failures, or other factors beyond our control.
